Lord Fairley has given the go-ahead to businesses seeking a judicial review of the Scottish Government's Business Support Grants policy, finding the bid “competent” and stating it was “suitable for urgent consideration”. The group of businesses spanning various sectors across retail, hospitality and leisure, are disputing the fairness of the Scottish Government’s decision to deny them grant support equal to that being offered in England and Wales.

Businesses in England and Wales are eligible to claim the full 100% grant on each property, however initially Scottish businesses were only eligible to claim the 100% grant on business rates per business. The Scottish Government has since relented to an extent, now offering a 75% grant on subsequent properties, however some businesses and opposition politicians have argued that this still leaves Scottish businesses at a disadvantage, and in some cases forcing firms out of existence.
